Terms of Use

Effective: 21 September 2026. These Terms govern your use of the Kitho application and related services operated by Hemerakey GmbH, Switzerland.

1. What Kitho is

Kitho is a relationship-awareness and cycle-tracking application. It can help you keep partner profiles, important dates and private context, and may generate estimates for future menstruation and ovulation based on recorded timing.

2. Eligibility and account responsibility

You are responsible for information entered through your account and for keeping account access secure. Kitho is not intended for use by children under 13. The product is designed primarily for adult account holders.

3. Respect for other people

Kitho may contain sensitive information about partners or other people. Only store information that you have a legitimate reason to keep and that the person concerned would reasonably be comfortable with you storing. Do not use Kitho for harassment, coercion, surveillance, discrimination or unlawful profiling.

4. Sharing

Where Kitho supports sharing or supporter access, the self-managing person controls the available cycle-sharing categories and can change or revoke access. You must not attempt to bypass those controls or obtain information that was not shared with you.

5. Apple Health and device services

Apple Health integration is optional and read-only. Other optional features may use contacts, calendar, notifications or photos after permission. Your use of Apple services is also subject to Apple's applicable terms.

6. Availability and changes

Kitho may change as features are improved or removed. We aim to operate the service reliably but do not guarantee uninterrupted availability or that estimates will always be available.

7. Your data

Our handling of personal data is described in the Privacy Policy. Kitho provides in-app data export and account deletion controls.

8. Intellectual property

The Kitho application, website, branding and original software are owned by or licensed to Hemerakey GmbH. Third-party software remains subject to its own license terms.

9. Limitation of responsibility

To the extent permitted by applicable law, Kitho is provided without guarantees regarding prediction accuracy, relationship outcomes or fitness for medical use. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Governing law

These Terms are governed by Swiss law, subject to mandatory consumer-protection rules that apply in your country of residence.
